Terms and conditions

General terms and conditions for the marnit.at online shop
Last updated: 21.10.2026

1. Scope and contracting party

These general terms and conditions (T&Cs) apply to all contracts we conclude with you on the basis of an enquiry via the online shop www.marnit.at. Your contracting party is Marnit GmbH, Weblingergürtel 33, 8054 Graz, Austria (see section 14).

A consumer within the meaning of these T&Cs is anyone who concludes a transaction that is not part of the operation of their business (§ 1 KSchG). Provisions that apply only to consumers or only to businesses are marked as such. Business customers’ own terms and conditions apply only if we expressly agree to them in writing.

2. Enquiry, offer and conclusion of the contract

Your enquiry is not binding. The products and prices in the online shop are not a binding offer. When you add products to the basket, enter your details (first name, surname, address, phone number, email address) and click “Send enquiry”, you send us a non-binding enquiry. This does not create any obligation to pay, and no contract is concluded yet. Before sending, you will see your details again at a glance and can correct any input errors.

Acknowledgement of receipt: After you send your enquiry, we automatically confirm by email that we have received it. This acknowledgement of receipt is neither an offer nor an acceptance.

Our offer: We review your enquiry, in particular availability, quantities, cutting and delivery method, and send you a written offer by email. The offer includes in particular:

  • the products with their main characteristics, quantities and dimensions,
  • the total price including 20% VAT and the delivery costs, each in euros,
  • the payment method, delivery method and expected delivery date,
  • information on whether and how you can withdraw from the contract, for goods delivered by freight carrier the estimated maximum return costs in euros, and the model withdrawal form, or for made-to-measure products the notice that there is no right of withdrawal,
  • a reference to your statutory warranty rights, with the harmonised EU notice on the legal guarantee, and
  • these T&Cs.

Our offer is valid for 7 days from dispatch unless it states a different period.

Conclusion of the contract: The contract is concluded when you accept our offer in writing within its period of validity, for example by an email to office@marnit.at confirming the order. If you wish to change the offer, your reply is a new order, and the contract is only concluded once we confirm that order in writing. After the contract has been concluded, we send you an order confirmation by email with all the contract details, the model withdrawal form and these T&Cs. The order confirmation also contains your order number.

Contract language and contract text: The contract language is German. We store the contract text. You receive the offer and the order confirmation by email. Please keep them for your records.

Made-to-measure products: Products that we cut or make to your measurements or specifications (for example worktops, vanity tops, stairs, window sills or tables) are marked in the offer as made to measure. We only make them once you have approved the dimensions or the site measurement in writing. A deposit may be agreed in the offer for made-to-measure products.

3. Prices and delivery costs

All prices are in euros and include 20% VAT.

The prices in the online shop apply to standard goods in the stated formats. For standard goods, our offer is based on the online shop price at the time of your enquiry. Cutting, made-to-measure products and special services are calculated separately in the offer.

Delivery costs are not included in the product prices. They depend on quantity, weight, format and delivery address. We state the delivery costs in the offer.

The total price and delivery costs stated in the offer you accepted are binding. We do not change the price after the contract has been concluded.

4. Payment methods

You can pay by:

  • Bank transfer to the bank account of Marnit GmbH
  • Payment on delivery directly to employees of Marnit GmbH, if we deliver the goods ourselves or you collect them from us in Graz

You always make payments directly to Marnit GmbH. Freight carriers, parcel services and other carriers are not authorised to accept payments on our behalf. The offer states which payment method applies to your order and when payment is due. You will find our bank details in the offer and in the order confirmation. If payment in advance has been agreed, we dispatch the goods as soon as we have received your payment. A deposit may be agreed for made-to-measure products (see section 2).

5. Delivery

Delivery time: We state the expected delivery date in the offer. We usually dispatch goods in stock within 2 working days of the conclusion of the contract, or, where payment in advance has been agreed, within 2 working days of receiving payment. Delivery takes 1–10 working days depending on the destination country. We deliver made-to-measure products and items ordered in on the date stated in the offer.

Goods delivered by freight carrier: We deliver slabs, tiles and other heavy products by freight carrier. Unless otherwise agreed, we deliver to the kerbside. The carrier will contact you in advance to arrange a delivery date. Please make sure the delivery address can be reached by lorry and that someone can help with unloading.

Transport damage: Please check the goods for visible damage on delivery and, where possible, note any damage on the delivery note. Please report transport damage to office@marnit.at as quickly as possible. This makes it easier for us to deal with the carrier. Your statutory warranty rights remain unaffected, even if you make no note or report the damage later.

Products not available: If a product you enquired about is no longer in stock, we will tell you so in our reply to your enquiry and, where possible, suggest an alternative.

Changes after conclusion of the contract: If the delivery time is significantly delayed after the contract has been concluded, or a product is no longer available in the agreed form, we will inform you immediately. You can then withdraw from the contract or choose an equivalent replacement item. If you withdraw, we will refund any payments already made without delay. Your statutory rights remain unaffected. We do not change the agreed price after the contract has been concluded.

Notifications: We will inform you about dispatch and arrange the delivery date by email, text message or phone.

6. Retention of title

The goods remain our property until paid for in full.

7. Right of withdrawal for consumers

As a consumer, you have a statutory right of withdrawal for distance contracts under the Austrian Distance and Off-Premises Contracts Act (Fern- und Auswärtsgeschäfte-Gesetz, FAGG). This also applies if the contract is concluded by email as described in section 2. If, on the other hand, you conclude the contract in the simultaneous physical presence of both parties in our showroom, there is no right of withdrawal under the FAGG. The following statutory model information uses the term “withdrawal” (Widerruf) for this. In these T&Cs, “rescission” (Rücktritt) and “withdrawal” (Widerruf) mean the same.

Withdrawal information

Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party other than the carrier and indicated by you, take physical possession of the goods. In the case of a contract for multiple goods delivered separately, the withdrawal period is fourteen days from the day on which you, or a third party other than the carrier and indicated by you, take physical possession of the last item.

To exercise your right of withdrawal, you must inform us (Marnit GmbH, Weblingergürtel 33, 8054 Graz, Austria, phone +43 699 16028713, email office@marnit.at) of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an email). You may use the attached model withdrawal form , but this is not obligatory.

You can also exercise your right of withdrawal online at https://marnit.at/vertrag-widerrufen/ (the “Withdraw from contract” button in the footer of every page of www.marnit.at). If you use this online function, we will send you an acknowledgement of receipt on a durable medium (by email) without delay, with the content of your withdrawal statement and the date and time it was received.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to Marnit GmbH, Weblingergürtel 33, 8054 Graz, Austria, without undue delay and in any event not later than fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods. For goods that by their nature cannot normally be returned by post (goods delivered by freight carrier), the cost depends on the distance in kilometres between the collection address and our premises in Graz. The cost is estimated at a maximum of approximately the amount in euros that we state for this in our offer and in the order confirmation.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

End of withdrawal information

Withdrawing online: The page “Withdraw from contract” is available to you throughout the withdrawal period without a customer account. There you enter your name, your email address and your order number as stated in the order confirmation, choose whether you are withdrawing from the whole contract or only part of it, and state where we should send the acknowledgement of receipt. You send the statement with the button “Confirm withdrawal” .

Reimbursement: If you withdraw, we reimburse 100% of the price of the goods delivered including 20% VAT, plus the cost of standard delivery. If you paid in cash on delivery, we will transfer the amount, by arrangement with you, to an account you specify. This costs you nothing.

Collection of goods delivered by freight carrier: On request, we will arrange the return collection of goods delivered by freight carrier for you. We calculate the cost according to the distance in kilometres between the collection address and our premises in Graz. If we collect the goods from the delivery address, we will charge you no more than the maximum amount stated in the offer. You can also return the goods yourself or drop them off with us in Graz.

Partial withdrawal: If you withdraw from only part of the contract, we reimburse the price of the returned goods including 20% VAT and the delivery costs to the extent attributable to those goods.

Exceptions to the right of withdrawal
Under § 18 (1) no. 3 FAGG, there is no right of withdrawal, among other things, for goods made to the consumer’s specifications or clearly personalised. This applies in particular to products that we cut or make to your measurements or specifications, for example slabs, worktops, vanity tops, washbasins, stairs, window sills, tables, memorial plaques and memorials. We mark such products in the offer as made to measure. You can return standard goods in standard formats, such as 60 × 120 cm tiles, as described above.

Notes on returns: Please return the goods unused if possible and well packed, ideally in the original packaging, and enclose a copy of the invoice. Use a trackable shipping method or bring the goods to us in person. These notes are not a condition for your withdrawal to be effective.

For business customers: Business customers have no statutory right of withdrawal. We consider return requests case by case, insofar as our suppliers allow it.

8. Model withdrawal form

You can also download the form as a PDF. To withdraw online, use https://marnit.at/vertrag-widerrufen/.

9. Warranty and product description for natural stone and tiles

Statutory warranty: The statutory warranty applies, for consumers under the Austrian Consumer Warranty Act (Verbrauchergewährleistungsgesetz, VGG). We are liable for defects that exist at the time of delivery and become apparent within two years of delivery. The period may be extended by law, for example after a repair. As a consumer, you can still assert your claims in court up to three months after the warranty period has expired. You are initially entitled to repair or replacement and, under the statutory conditions, also to a price reduction or termination of the contract. We can neither exclude nor restrict these rights towards consumers.

EU notice on the legal guarantee: You will find the harmonised EU notice on the legal guarantee of conformity (Implementing Regulation (EU) 2025/1960) in our online shop before you send your enquiry, and in our offer. You can find more information about your rights at europa.eu/youreurope/garantien.

Natural stone is a natural product. The following description forms part of the product description of every natural stone product. It describes the usual characteristics of the material and does not restrict your warranty rights.

  • Colour, figuring and veining vary from slab to slab, within a slab, between slab and sample, and compared with the photos in the online shop. Colour reproduction on screen also differs from the original.
  • Natural structural features such as pores, holes and open areas (for example in travertine), inclusions, fossils, quartz, calcite and glass veins, and hairline cracks (fine, closed hairlines in the stone) are typical of many natural stones.
  • Filler and resin areas: In many stones, such as travertine, marble or granite, natural pores, holes and hairline cracks are filled or consolidated with filler or resin at the factory. These areas may differ slightly in colour and sheen.
  • Samples and photos show the typical character of a stone. They do not show the exact appearance of the slab you will receive. If you want a particular slab, you can choose it by appointment in our showroom, and we will record your choice in the offer.

These features are not defects as long as they are within what is usual for the type of stone and grade concerned and do not impair fitness for use, such as strength and resistance to breakage. Breaks, cracks that impair stability, or features beyond what is usual for the material are defects for which we are liable under the law.

Different grade: If we supply goods that differ from the usual standard (for example second-choice goods or a grade with more filled areas), we will point this out to you specifically in the offer. Such a deviation is only deemed agreed if you expressly and separately accept it when concluding the contract.

Tiles and porcelain stoneware: Shade and calibre may differ slightly between production batches. So, if possible, enquire about the quantity you need in a single order. For later additional orders, we cannot guarantee delivery from the same batch unless we agree this in the offer.

Checking before installation: Please check the goods before laying or processing them, ideally by laying several slabs or packs side by side. If possible, report visible defects to office@marnit.at before laying, so that we can supply replacements quickly. Your statutory warranty rights remain unaffected.

Care and use: Please follow our care and installation instructions. The warranty covers defects that exist at the time of delivery. Damage that only arises afterwards through improper care, unsuitable cleaning products, improper installation or normal wear and tear is therefore not a warranty case. This does not apply if an error in our care or installation instructions is the cause.

For business customers: For business customers, §§ 922 et seq. of the Austrian Civil Code (ABGB) and §§ 377 f. of the Austrian Commercial Code (UGB) apply. Defects must therefore be notified to us in writing without delay after delivery.

10. Liability

We are liable for personal injury in accordance with the statutory provisions, including in cases of slight negligence.

For consumers: We are also liable for all other damage in accordance with the statutory provisions. We do not limit our liability towards consumers.

For business customers: We are liable for property damage and financial loss if we caused them intentionally or through gross negligence. We are not liable to business customers for slight negligence. This does not apply to personal injury or to damage to items we have taken over for processing. These rules also apply to the liability of our employees and vicarious agents.

Claims under the Austrian Product Liability Act (Produkthaftungsgesetz, PHG) and your warranty rights remain unaffected.

The online shop may be temporarily unavailable or only partly available because of maintenance or technical problems. In that case you can declare your withdrawal at any time by email or letter.

11. Data protection

We process your personal data only as far as necessary to handle your enquiry, prepare the offer, perform the contract, and handle delivery, payment and communication with you. For this purpose we pass the necessary data on to freight carriers, parcel services and payment service providers. You will only receive our newsletter if you have expressly signed up for it. You can unsubscribe at any time.

You have the right to access, rectification, erasure and restriction of processing of your data. To exercise these rights, contact office@marnit.at. You can find all the details, including your other rights and cookies, in our privacy policy.

12. Complaints and dispute resolution

If you have questions or complaints, you can reach us by phone on +43 699 16028713 or by email at office@marnit.at. We treat every complaint confidentially and aim for a quick, amicable solution.

If we cannot reach an agreement, we are willing to take part in conciliation proceedings before the competent Austrian consumer conciliation body:
Schlichtung für Verbrauchergeschäfte (Consumer conciliation body)
Flachgasse 30/2nd floor, 1150 Vienna
Email: office@verbraucherschlichtung.at
Website: www.verbraucherschlichtung.at

13. Applicable law and place of jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory consumer protection provisions of the country in which they have their habitual residence.

If we sue a consumer who is domiciled or habitually resident in Austria or employed here, only the court in whose district the domicile, habitual residence or place of employment is located has jurisdiction. For business customers, the place of jurisdiction is the court with subject-matter jurisdiction for 8054 Graz.

We may change these T&Cs for future contracts. Your contract is governed by the version we sent you with the offer.
